A special POCSO court in Mumbai has sentenced a 58-year-old man to 10 years rigorous imprisonment in a case related to sexual assault of a five-year-old boy in 2018. Later, a case was registered in this case. Investigation of Chicken Vendor Protection of Children from Sexual Offenses (POCSO) Act Section 6 (Aggravated Sexual Harassment). A person found guilty under this section of the POCSO Act can be sentenced to life imprisonment. However, in this case due to lack of penetration, the court sentenced the accused to 10 years rigorous imprisonment in the case.

Accused Mohammad Khatir Sheikh called it in court ‘Diabolical mistake’ Told. After hearing the arguments, Judge MA Baralia convicted the accused under Section 6 of the POCSO Act. The accused’s lawyers told the court that his wife and five daughters live in his hometown. Three of his daughters are married. He has the responsibility of his two daughters and wife.

In addition, the accused is also responsible for a brother, who is blind. Therefore a liberal approach can be adopted, given his family and financial background. Although the prosecution had asked for maximum punishment, the court awarded the minimum sentence in view of the ‘poor financial condition’ of the accused.
