The consent of the plenary session of Congress for the Judiciary Commission to conduct a summary investigation of the members of the Judiciary Commission for serious reasons National Justice Office (JNJ) continues to cause concern at home and abroad.
Constitutional lawyer Raúl Ferrero Costa considered that it was a complex issue that needed to be analyzed calmly because it had a major impact on the justice system.
“You have to be very careful. We want an independent judiciary and we want the public prosecutor’s office to function with the same independence. It is worrying because it causes great damage to legal stability,” said Ferrero Costa.
For his part, constitutional lawyer Edgar Carpio Marcos noted that Congress should not decide lightly given a history of such cases that have reached the Inter-American Court of Human Rights. He also mentioned that many hypotheses are being made against the JNJ judges, but there are no concrete, proven facts.
He explained that the Inter-American Court believes that any person subjected to a trial regarding their rights and freedoms recognized in the American Convention on Human Rights must be proven guilty of their errors in order to be punished.
“The final decision must be based on proven facts. I think we have to wait because it could just be a volley in the air. I think that Congress should not make a rash decision given the many precedents on this issue,” Carpio Marcos said.
In favor of the prosecutor
Regarding the confusion that is trying to create by comparing the situation of the JNJ with that of the CNM, former Congressman Gino Costa explained that the “Los Cuellos Blancos” of the CNM was suspended by Congress in 2018 for serious misconduct that was made public in 2018 , the audios of shame were removed from office. “Congress wants to remove her to protect prosecutors from investigations that could lead to her firing.
