Accused of sharing HIV with his partners: he renounces his confession to stay in the village

A Montrealer who pleaded guilty to the crime of transmitting HIV to two family members is now recanting his confession and asking the court to increase his chances of staying in Canada.

“At the time of committing the crime, the defendant felt dizzy from the fact that he found it difficult to experience. […]found himself in a dissociative state, Alfredo José in his petition heard Monday morning in a Montreal court.

José, 59, is a former nude dancer who hid from his partners that he was HIV positive. But still this defendant seemed to be secure in his defense. For in the case of the two victims, the relationship was numerous and “never secured”, the sum of the facts indicates.

So he transmitted the virus to his first partner in 2008.

“He developed health problems in 2008 and after certain medical tests, he learned that he was an HIV carrier,” the court document reads.

The woman discovered after 5 years that it was José who had transmitted the virus to her, after she saw a container charged with the name triple therapy medicine.

A second victim discovered a pot of roses in 2015 after speaking to the accused ex-spouse.

Arrested in 2016 and charged with aggravated sexual assault, Joseph ultimately cut his trial short by pleading guilty to a charge of criminal negligence causing bodily harm. It was 2020.

However, the case was dragged on for three years, so much so that Joseph still did not receive a verdict. It could also increase the delay, since the defendant now wants to withdraw the defendant, for the reason that he did not understand what all of his decision is to confess.

“I can neither read nor write,” testified Joseph, this Monday, with the help of a Spanish-French interpreter.

In his motion, his lawyer, among other things, said that he had done his job badly and about the consequences of his status in Canada, even though he claims that he did his job according to the rules. art., among other things referring the client to an immigration attorney.

After this hearing, before Judge Ivone Paradis, the court is scheduled to receive a three-day hearing.

If the request is denied, it will take several weeks before Joseph receives a decision. If the accused has fulfilled his goals, the delays can be counted in months, when everything begins.
