At least once, DPS officers did not arrest immigrants at the site of the alleged raid, but instead picked them up at a border patrol station.
And in at least 35 cases of immigrants who were processed by DPS for trespassing, the Border Patrol was the agency that made first contact with and apprehended the immigrants.
“(Border Patrol) instead of processing the people for immigration purposes, transferred them to DPS for prosecution as part of Operation Lone Star,” the complaint said.
The ACLU recognized that Abbott’s operation was designed with the “clear and stated purpose of punishing immigrants based on immigration status”.
The complaint stems from an analysis of police reports on more than 350 trespassing arrests made this summer as part of Operation Lone Star.
The ACLU has asked the DHS to investigate and stop the Border Patrol’s involvement in the Texas operation.
