LOS ANGELES—Britney Spears’s new attorney on Monday petitioned to remove her father from the custodial position that has controlled her life and wealth for 13 years, and to replace her with a professional accountant.
Matthew Rosengart said in documents filed in Los Angeles Superior Court that the current legal system “has become increasingly toxic and can no longer be tolerated.”
He proposed that James Spears be replaced with CPA Jason Rubin as custodian of the pop star’s wealth, which documents say is equivalent to $2.7 million in cash and more than $57 million in assets.
Rosengart said in the filing that before he sought to end the conservatism, he was first “addressing the most pressing issue facing Ms. Spears: the removal of Mr. Spears as custodian of the property.”
“Any father who truly loves his daughter and has her best interests at heart, should voluntarily step up in favor of the highly respected professional fiduciary named here,” Rosengart said in the documents.
Britney’s mother and James’ ex-wife Lynn Spears supported Rosengart’s filing, saying in a declaration that her “micro-control” over her health care and business decisions was particularly damaging at a critical period in 2018 and 2019.
“This kind of investigation is exhausting and terrifying, like being in custody,” Lynn Spears said.
James Spears stepped down as the man’s so-called custodian for his daughter in 2019, handing control of his life decisions and health care to court-appointed professional Jodie Montgomery while maintaining control of her finances.
A message sent asking for comment from James Spears and his legal team was not immediately returned. But at a July 14 hearing, his lawyer, Vivian Thorin, said he would not step down and was motivated only by his daughter’s best interests.
Thorin said that Britney Spears had many misconceptions, among them that “her father is responsible for all the bad things that happened to her.”
Judge Brenda Penney allowed Britney Spears to appoint an attorney of her choice at a hearing for the second time after the singer publicly broke down a 2008 stereotype that she called “brutally” described. For him.
“My dad needs to be fired today,” she said, adding that she wants him to be accused of abusing his position.
Penny has yet to show any inclination to remove James Spears, and this isn’t the first time Britney Spears’ attorney has sought her father’s removal.
Last year, Rosengart’s court-appointed predecessor, Samuel Ingham III, proposed that James Spears be replaced by estate-management firm The Bessemer Trust. Instead Penny ruled that Jamie Spears and the firm should work together, but Bessemer dropped out of the arrangement before it could formally begin.
Ingham resigned after a theatrical hearing in June when the pop star publicly denounced the stereotype for the first time, telling Penny: “I just want my life back.”
A hearing is scheduled for September 29 to address Rosengart’s petition and other issues in the guardianship.
