Luxembourg—Billions of people use Google because it’s best, not because of the deals the company has struck to stay competitive, Google’s lawyer said Friday, wrapping up a week of testimony as the US tech giant records Fights $5 billion antitrust fine.
The European Commission fined Alphabet’s Google 4.34 billion euros ($5 billion) in 2018 for using its Android mobile operating system to thwart rivals and consolidate its dominance in general Internet search since 2011.
The issue requires phone makers to pre-install the Google Search app and Chrome browser app with Google Play, as well as deals blocking certain variants of Android.
“The reason why billions of people choose Google as their search tool every day is not an abuse of dominance. It is because it is the best,” lawyer Meredith Pickford told the European Union’s General Court, the bloc’s second-largest court.
Pickford said the deals were far from being an anti-competitive tool, but rather they were meant to ensure that Google remained competitive.
“You can still compete hard and compete on merit. Consumers are not fools. If Bing or any other search engine was better than Google, people would turn to it,” he told a rival Microsoft Corp. Search Referring to the engine.
“Successful companies do not survive by resting on their laurels and failing to compete,” Pickford told the court.
European Commission lawyer Nicholas Khan said the deals showed Google had stacked the odds in its favor and urged judges to uphold the commission’s ruling and fines.
“Google gives itself a laurel wreath even before the race starts,” Khan said. “The scale of the practices fully justifies the fines imposed.”
It was unclear when a decision would be made in this case, which is T-604/18 Google v. European Commission.
