DA: Cuomo has not been charged in connection with the charges against the two women

WHITE PLAINS, New York ( Associated Press). The county attorney said on Tuesday that former New York Governor Andrew Cuomo will not face criminal charges related to charges of unwanted kissing by two women, one of whom is a state soldier assigned to his command.

Westchester County District Attorney Mimi Roca said that while there is evidence to conclude that the behavior described by the women did indeed take place, the office cannot open a criminal case.

“In both cases, my office determined that, despite the credibility of the accusations and witnesses, and the conduct associated with it, we were unable to prosecute because of the statutory requirements of New York City criminal law,” Roca said in a statement.

A message requesting comment was left to a spokesman for Cuomo.

An August report from Attorney General Laetitia James documented charges by 11 women against Cuomo, leading to his resignation, although he called the findings biased and inaccurate.

In October, the Albany County Sheriff’s Office filed a misdemeanor complaint against Cuomo, but a week later, the district attorney asked the judge to give him more time to assess the evidence.

The district attorney said the one-page criminal complaint from the sheriff based on the woman’s allegations that Cuomo slipped his hand up her blouse and grabbed her by the chest at the governor’s mansion in late 2020 was “potentially defective.”

The alleged incident in Westchester County involving a soldier took place at Cuomo’s home on Mount Kisco, according to the district attorney. The soldier told investigators that after she asked the governor if he needed anything, he responded by asking if he could kiss her.

The soldier was worried about what would happen if she refused, so she told investigators that she replied, “Of course.”

In another incident, Cuomo allegedly greeted a woman by grabbing her hand, pulling her close and kissing her cheek as they were both at an event at White Plains High School, according to the district attorney.
