In the petition, Parambir Singh called for protection, calling himself a Whistle-blower. He demanded a moratorium on two preliminary investigations launched against him by the Maharashtra government. These orders were given by the state government on 1 April and 20 April this year.
In the petition, he has accused the state government of citing both the orders, that all this is being done to target and harass them. The petition has said that the action being taken by the state government against them is against Articles 14, 19, 21 of the Indian Constitution.
According to live law, The petition also claimed that when Parmibar Singh met Maharashtra DGP Sanjay Pandey on April 19, he had ‘advised’ to withdraw the letter written against former state home minister Anil Deshmukh. Earlier on Wednesday, FIR was lodged under SC / ST Act against several other police officers including Parambir Singh.
Significantly, after being removed from the post of Mumbai Police Commissioner, Parambir Singh wrote a letter to CM Uddhav Thackeray. In this, the then Home Minister, Anil Deshmukh, was accused of recovery through suspended Inspector Sachin Waje. He claimed that Deshmukh gave Vaje Recovery of hundred crores Was targeted Initially postponed, Deshmukh had to resign due to these allegations. Recently, the CBI had registered an FIR against him in this case. At the same time, Vaje is currently under the custody of the NIA in the Antilia bomb case.
What did the lawyer say on behalf of Parambir Singh?
On behalf of Singh, senior advocate Mukul Rohatgi appeared before judges SS Shinde and Manish Pitale on Thursday. Rohatgi gave information about both the orders of the state government. He told that when Singh met the DGP on 19 April, he advised him to withdraw the letter.
According to Rohatgi, “Pandey told Singh that he cannot fight the system in this way and the same government is now starting an investigation against him (Singh) in all criminal cases. Pandey advised him to withdraw his letter sent to the government. “
According to Rohatgi, the state government is only making fabricated complaints against Singh. Singh has also recorded his conversation with Pandey and has given a copy to the CBI. Rohatgi stated that the orders given by the government to initiate a preliminary inquiry against Singh are clearly arbitrary, completely illegal, void and baseless. Explain that in this case government advocate Deepak Thackeray asked for time to react.
What did the court say?
After hearing Rohatgi’s pleas, the court wanted to know whether Singh was issued a show cause notice during the investigation. If not, what is the hurry? The court said, “Why do we need to pass the interim order in a hurry?” This investigation is being done on violation of service rules. Therefore, it is a matter of service. Let the government respond to the allegations in the petition. “
