Man charged with murder after daughter’s death in hot car

Snellville, Ga. ( Associated Press) — A Georgia man was charged Wednesday with second-degree murder after his 8-month-old daughter was killed after she was left in a hot car after she pulled a gun from the police department. The pick had gone and ended up being arrested, the officials said.

Snellville Police Detective Jeff Manley said during a news conference Wednesday that 20-year-old David Zapez McCurry Whatley went to the Snellville Police Department at around 2:15 p.m. Tuesday to retrieve a gun kept in the property department. Before issuing a weapon, police conduct background checks, which are standard practice to ensure that a gun is not being issued to someone with a felony conviction.

Officers found Whitley had a warrant for his arrest for a probation violation and took him into custody, Manley said. Manley said that when Whaley arrived at the police department until he was sent to the Gwinnett County Jail — lasting more than 40 minutes — he was recorded on police body cameras and dashcam video.

“He didn’t make a statement about the fact that his daughter was dropped off in a car across two buildings from the Snellville Police Department,” Manley said.

About seven hours later, the child’s grandmother arrived at the emergency room with the child, who was dead. Officers then determined that the child, Nova Grace Whatley-Trejo, had been left in the car outside City Hall and was taken out of the car by her grandmother.

Manley said Whaley, who lives in Grayson, had been released from prison Tuesday evening on charges of probation violations. But he was arrested again Wednesday morning and charged with second-degree murder, Georgia Bureau of Investigation agent Lisa Voarasi told reporters.

A second-degree murder charge in Georgia means someone has caused death by committing second-degree cruelty to children, regardless of the motives. It carries a prison sentence of 10 to 30 years.
