Patricia Benavides asked the Judiciary to extend a precautionary measure to suspend the immediate disciplinary process | Ministry of Public | Congress | policy

The State Prosecutor, Patricia Benavides presented a request to extend the precautionary measure – before the Judiciary – that favored him, weeks ago, with the suspension of the investigative processes opened by National Board of Justice. With this, the alleged leader of a criminal organization will seek to paralyze the new immediate disciplinary process initiated by the JNJ against him for interfering with the Plenary votes by offering instead support for the filing of tax investigations to congressmen.

The appeal entered the PJ on Wednesday, November 29 at 3:27 pm. The document reads as follows: “I request that the effects of the precautionary measure be extended and, consequently, the effects of resolution 194-2023-PLENUM be suspended – JNJ, on November 28, 2023, by the National Board of Justice.”

Patricia Benavides is being investigated for alleged influence trafficking

According to the research work of Special Group of Prosecutors against Corruption of Power and the National Police, according to the fiscal thesis, Patricia Benavides was investigated for illegally influencing the removal of the National Board of Justice (JNJ), the appointment of the Ombudsman, Josué Gutiérrez, and the disqualification of Zoraida Avalos in Congress of the Republic. Because of this, the MP leader was accused of the alleged crime of influence peddling.

Within the framework of the disqualification of Zoraida Ávalos, in the chats of Jaime Villanueva, it was seen that the Public Ministry made an estimate of which congressmen they would favor with their votes and could be “supported” in filing their cases. Finally, Folder No. 283-2022 was archived and, with it, about 40 parliamentarians benefited.

PJ ordered to suspend the preliminary investigations against Benavides

In mid-October, the Sixth Constitutional Court presiding magistrate Jacqueline Tarrillo, decided to grant the precautionary measure requested by the Attorney General, Patricia Benavides, against the National Board of Justice (JNJ). In this, the immediate suspension of the preliminary investigation conducted by the JNJ to Benavides Vargas was ordered.

They asked to suspend Patricia Benavides

On the other hand, the Board of Supreme Prosecutors requested – through a letter – the resignation of the Attorney General, Patricia Benavides, after learning that she was being investigated for allegedly leading a criminal organization from the top of the Public Ministry. Through his operator, Jaime Villanueva, who is his advisor, he sought to exchange the votes of congressmen for important issues in exchange for their benefit in archiving investigations.

What should be the replacement – on an interim basis – of Patricia Benavides, if she is suspended by the JNJ, from the Board of Supreme Prosecutors. Currently, there are two options. The first is Pablo Sanchez who held this position between July 5, 2015 and June 7, 2018.

Finally, there is also the possibility of Juan Carlos Villena Campana, who is one of the signatories of the resignation request addressed to Patricia Benavides. The case of Delia Espinoza has particularity that the Judiciary recently rejected the precautionary request presented by the supreme prosecutor and current magistrate of the National Election Jury (JNE) to be returned to the Board of Supreme Prosecutors. He continued to beg for her return.
