Sanjuaneraso’s case before the court

judge Anthony Cuevas Ramos He is assigned to participate in the Superior Volleyball League demanded by the Sanjuaneras de la Capitale against the Puerto Rican Volleyball Federation (FPV).

The lawsuit is evident from the digital order of SJ2021CV05725, which was filed by Sanjuaneras on 3 September and seeks to cripple (prohibit) the league’s final series, which was canceled by FPV on Sunday, before Sanjuaneras did not appear. .

A motion was introduced on Monday to summon FPV president Cesar Trabanco. He had previously called the tournament director, Jose ‘Picky’ Severra.

The case was registered on Friday. After a long weekend, they had to wait for today.

Cuevas Ramos was a judge hearing a significant sports case in 2019, in which FPV was also prosecuted and in which rights on grassroots sport granted to federations affiliated with the Puerto Rico Olympic Committee were questioned by plaintiffs. (Kopur), as is FPV.

It was this case that questioned the payment of money to guarantee the holding of private volleyball tournaments. Cuevas Ramos dismissed the suit.

That case also attracted national attention as it challenged the sporting autonomy of national federations through a declaratory sentence.

“Concerning the declarative sentence, it is hereby declared that the Puerto Rican Volleyball Federation, the Puerto Rican Soccer Federation, the Puerto Rico Basketball Federation and the Puerto Rico Table Tennis Federation, as well as all national federations affiliated with the Olympic Committee of Puerto Rico, are private entities. which, through voluntary affiliation contracts or approval with their participants, have established rules that comply with federal obligations to international organizations in accordance with the rules applicable to the Olympic Movement and governing said sport. Puerto Rican Volleyball The federation does not violate any constitutional right and sport is protected by autonomy,” Cuevas Ramos wrote in the ruling.

Sanjuanares and FPV are in litigation after the body did not approve the replacement of the team’s reinforcement players for the start of the final series against Criollas de Caguas. San Juan requested a replacement because the player (Destiny Hooker) was going through a high-risk pregnancy.

The San Juan team was eventually suspended for a year for failing to make it to the final series, and as a result, the Creoles were declared champions.

The FPV twice declared the replacement request ‘Not Applicable’ as the rules for this type of action only consider causes of bodily injuries. He didn’t consider the pregnancy an injury. Nor did it consider amending the regulation to include pregnancies. A third ‘no place’ was ordered by the Court of Appeals and Sports Arbitration (TAAD), Kopur.

Yesterday, Trabanco said for the first time in the controversy that the conditions of pregnancy should be considered and present in the rules with due discussion from all sectors.

“Certainly, health conditions, such as pregnancy, deserve evaluation with rigor and respect for future tournaments,” he wrote in a statement.

The FPV has said it has allowed itself to be carried away by the rules for declaring San Juan’s request “no space”. He also said that he used the rules to impose punishment on the jujuers.
