Baselby Sr. apologizes to truck driver and dies
A Bosnian from the canton of Schwyz ran over a pedestrian in Liestal BL two years ago. Shortly thereafter the senior died. Now the truck driver came to the court and told how the seriously injured should have apologized to him.

This tragic accident happened on a rainy morning of June 2020. A Bosnian (32) from the canton of Schwyz, who was at that time an employee of a security company, wanted to use his truck to collect files from a bank in Listel bl for destruction. This branch is located in the meeting area on Rathausstrasse. The truck driver was not there the first time. He has been working regularly for more than a year.
He always went backwards in the Rathausstrasse. But this time he overlooked a pedestrian († 97) who was walking with a walker and an umbrella.
The pensioner was hit by the truck in reverse gear and was seriously injured. The 97-year-old died of pulmonary fat embolism in hospital three days later. On Monday, the driver had to answer in the Basel criminal court in Mutenz for negligent murder, according to the “Basler Zeitung” report.
Court stresses on duty of care
The truck driver said that he spoke to the accident victim immediately after the collision. The Bosnian hugged the man and put his jacket over him. “Don’t blame yourself,” the injured man has said. “I was not paying attention.”
Senior’s pelvic bones and limbs, ribs on both sides and parts of the cervical spine were broken. It was clear to the court: The truck driver acted negligently and breached his duty of care. Because he should have gone on. It would have been possible to turn. In addition, he should have run more slowly, called an assistant and paid more attention to the right of way for pedestrians.

The truck driver claimed that the place is often occupied by other suppliers. Plus, obstacles like blinds and chairs don’t leave enough room to turn. He knew that the visibility was poor that day due to the rainy weather. So he sought help from one or more passers-by for his planned maneuver. But since no one made himself available for it, he himself left. «All the passersby were tense and it was raining. Apart from this, we always work under time pressure in the transport sector,” said the 32-year-old.
In principle, however, the accused admitted the facts mentioned in the indictment. In the end, the Public Prosecutor’s Office was not short of evidence: in addition to reports and reports from police and forensic examinations, investigative officers also evaluated his speedometer and video material showing the entire course of the accident.

The public prosecutor sought a conditional prison sentence of eight months. Truck Driver Shows Remorse: “This accident left its mark on me.” He had contacted the families of the victims of the accident, apologized and offered condolences. “It was important to me,” he said.
The court eventually sentenced him to a conditional fine of 90 daily rates of CHF 160 each. They also have to pay procedural costs of about 13,000 francs. The decision can still be appealed and is therefore not yet final. (No)
