“In this sense, the Third, Sixth, Seventh and Ninth Civil Courts of First Instance with national jurisdiction will hear the aforementioned cases in the first instance. While in the second instance the Third, Ninth and Tenth Superior Courts in civil matters, with national jurisdiction, will do so, the TSJ reported in a proposal .
Civil cases will deal with asset forfeiture until special ones are created
He added that the assignment was made from the First Transitional Provision of the Organic Law on Asset Forisfacture.
This established that the TSJ must create courts of first and second special instances in cases of extinction, with national jurisdiction, within 60 days after the entry into force of the regulations; and until special courts are created, the jurisdiction will correspond to the civil courts of the first instance, and to the superior civil courts.
The resolution adds that the Civil Chamber of Cassation of the Supreme Court is delegated the coordination of courts with jurisdiction in cases of extinction of ownership.
“Furthermore, courts that have cases with seized and recovered assets must notify their report to the service of the recovered assets within 30 business days,” TSJ said.
The proposal also states that the Executive Directorate of Magistrates will provide the Civil Director of the Metropolitan Area of Caracas with the support necessary for the best operation of the special courts of first and second instance.
In addition, the National School of Magistrates will establish a permanent system of judges and personnel who integrate these special courts.
