State of Mexico.- The prosecutor of Morelos, Uriel “N”, who remains in the maximum security prison in the mountains, obtained two protections from federal judges against new warrants of arrest.
The Sixth and Eighth District Courts in Matters of Amparo and Federal Trials of Edomex granted suspensions, temporary and direct, to prevent new arrest, location, search, appearance and presentation orders from being enforced against them.
Judge Enrique Vázquez, of the Sixth Court, allowed the temporary suspension so that “if the crime for which the warrant of arrest is requested is issued a warrant of preventive detention, once the plaintiff is arrested, it will remain in the amparo court. .” in the place where he is detained, as far as his personal freedom is concerned, remains at the discretion of the judge in the case, for the continuation of the procedure.”
In the event that, if the crime does not qualify for preventive detention, the prosecutor cannot be deprived of his personal freedom, until the appropriate definitive suspension is resolved, but the procedure against him will not be paralyzed, according to the national media.
While the protection provided by the Eighth Court refers to acts of torture or forced disappearance, so that these effects are stopped when they are inside the prison.
“In the same way, those responsible are required to ensure that, if it is the case that Uriel Carmona Gándara is detained for committing a crime and is at the disposal of the Public Ministry, it resolves his legal situation within forty and eight hours established in article 16 of our Fundamental Charter, or ninety-six hours in cases of organized crime, counted from the moment it is made available to you, that is, you order their freedom or hand them over before the corresponding judicial authority,” the agreement states.
Recall that the prosecutor was arrested for three crimes: delaying justice, disguise by favoring and femicide, as an assistant; His release was ordered for the first two crimes, but he remains in preventive detention for the third. In all three cases he was involved in the proceedings.
